Legalisation:
For some legal documents to be effective outside the United Kingdom, they must be ‘legalised’. Legalisation is the official confirmation that the signature, seal and stamp of the notary is that of a genuine, practising UK notary public.
Stage one involves the Foreign and Commonwealth Office (FCO): they verify the notary’s signature and attach an ‘Apostille’ to your document or to the Notarial Cover Sheet prepared by the notary.
Stage two: some countries require a further verification process from their embassies or consulates. We can do all this for you, just ask.
Originals or certified copies; what documents may be legalised?
If you want to legalise a certified photocopy of a document you should check with the end users of the document that this is acceptable to them; some documents must be originals. Some time only original documents maybe legalised, sometimes the reverse!
For example : -
Document in connection with getting married abroad: Certificates of No Impediment (CNI) or 'No Trace' letters - only original CNIs and letters issued by the General Register Office confirming that there is no trace of an individual currently being married can be legalised.
Only original death certificates issued by a UK coroner can be legalised.
National Identification Certificates, Association of Chief Police Officer certificates and Disclosure documents: only original with an official signature can be legalised.
UK Educational Documents. Educational documents which are not degrees, diplomas, certificates, qualifications or other awards may be legalised if they have been issued by an educational establishment in the UK. Documents which are degrees, diplomas, certificates, qualifications or other awards can be legalised if they were issued by a recognised educational establishment – we can advise in individual cases.
British passports: Only notarised photocopies of the bio data page of British and foreign passports may be legalised; original passports of any nationality may not be legalised.
Wills:
if you own property overseas it is a good idea to have your Will specifically mention the property and have the Will notarised. Many European countries have an official Registry of Wills; some property owners have separate Wills for their foreign estates. – we can advise in individual cases.
Foreign language translations of UK documents:
Foreign documents which require legalisation may be appended to a notarial coversheet, only the notarial certificate is legalised. Alternatively photocopies of foreign documents can be legalised as being true copies of the original document.
Terms of Business and Compliance Information
FEES:
Fees are assessed mainly by reference to the time spent on the matter, on the basis of an hourly charging rate. My current hourly rate is £180 subject to a minimum fee of £80. (although there is a discount available for regular clients). I charge extra for out of hours appointments, by negotiation. I release documents upon payment of my invoice. Rates are reviewed from time to time.
In accordance with notarial practice guidelines (which stipulate that fees should be fair and reasonable having regard to all the circumstances of the case), my fees may also include an additional element reflecting other factors including value, importance, speed, complexity or special skills.
If instructions are terminated for any reason, a charge will be made for all work carried out to date. Separate charges are made for any disbursements or expenses incurred on your behalf. You may be asked to provide monies on account. Costs include preparatory and drafting work, correspondence and attendances. My practice is not registered for value added tax, and expenses and disbursements will be charged gross.
ESTIMATES: It is difficult to estimate in some cases how much time will be required to complete a matter, bearing in mind the variety of circumstances that may arise. However, guidance as to likely costs will be given on receipt of instructions and sight of documents. Any estimates given will be based on the information available at the time and, although given in good faith, will not be binding.
INVOICES: Fees are normally due for settlement on completion of work and prior to release of completed documents. Invoices are delivered where required for work carried out, expenses incurred and disbursements made during the conduct of a matter.

How to pay:
I accept payment by cash, debit card, credit card, business cheque or bank transfer. Payments by credit card will be subject to a card handling charge. I regret that I am unable to accept personal cheques.

Invoices must be settled within 14 days or, if requested, immediately if further work on the same matter is required. Any queries concerning an invoice should be raised immediately upon receipt.
In the event of payment not being made as requested, I reserve the right to decline to act any further on your behalf and/or to exercise a lien on any papers or documents which are in my possession, until payment has been made.
Interest is chargeable from the date of the invoice on invoices outstanding for more than 7 days at 4% per annum above Royal Bank of Scotland base rate from time to time in force.
MONEY LAUNDERING COMPLIANCE: I operate a money laundering reporting procedure as required by law whereby, in the event of any suspicion as to money laundering, information will be revealed to the appropriate authorities. You will be required to provide satisfactory proof of identity and may be required to provide full details of the source and proposed destination of funds.
LIABILITY: I accept your instructions only on the basis that I shall not be liable for any direct, indirect or consequential losses, (all three of which terms include, without limitation, pure economic loss, loss of profits, loss of business, depletion of goodwill and similar loss), costs, damages, charges or expenses, directly or indirectly incurred as a result of any acts or omissions, howsoever arising, of any agents, subcontractors, couriers or other third parties, whether or not appointed by me at your request or appointed by you or your representatives to legalise and/or deliver the notarised documents to the end recipient unless such acts or omissions arise as a direct result of my wilful default. The risk in the notarised documents shall at all times remain with you.

2. If you are dissatisfied about the service you have received please do not hesitate to contact me.
3. If I am unable to resolve the matter you may then complain to the Notaries Society of which I am a member, who have a Complaints Procedure which is approved by the Faculty Office. This procedure is free to use and is designed to provide a quick resolution to any dispute.
4. In that case please write (but do not enclose any original documents) with full details of your complaint to :-

If you have any difficulty in making a complaint in writing, please do not hesitate to call the Notaries Society/the Faculty Office for assistance.
5. Finally, even if you have your complaint considered under the Notaries Society Approved Complaints Procedure, you may at the end of that procedure, or after a period of eight weeks from the date you first notified me that you were dissatisfied, make your complaint to the Legal Ombudsman, if you are not happy with the result:

6. If you decide to make a complaint to the Legal Ombudsman you must refer your matter to the Legal Ombudsman within six months from the conclusion of the complaint process.
